Florida's Fancy Shih Tzu's Pet/Companion Puppy
Agreement. Spay/Neuter Contract plus 3-year Health
Guarantee
Breeder guarantees that a licensed Veterinarian has examined this
puppy and has found said puppy to be in good overall health before
going to his or her new home. The buyer has 7 business days to have
said puppy examined by a licensed Veterinarian to begin the 3-year
health guarantee. The results obtained by the licensed Veterinarian can
be e-mailed or mailed to me within 14 days of the examination. Failure
to comply may VOID the 3-year Health Guarantee. Proof must be
available upon request.
This Guarantee is against Congenital Defects. This is defined as a
condition which dates to the fetal stage and would severely impact the
quality of life and be considered life threatening pertaining to said
puppy. These conditions are limited to the heart, kidneys, liver and
lungs from the date of said puppy's birth. Absolutely no other
conditions are covered in this contract.
In the case that said puppy should develop any of the above
conditions this contract guarantees a Replacement Puppy. No money
will be refunded.
* Buyer is aware this Health Guarantee is for a Replacement Puppy
and that no money will be Refunded under any circumstance.
* Buyer has/will fully educate themselves of common heath
conditions/ailments the breed may be predisposed to.
* Buyers understand that Hernias "Inguinal and Umbilical,"
Pinched or Tight nostrils, Open Fontanel more commonly known
as a soft spot, Coprophagia/stool eating, cherry eye, or any other
Shih Tzu prone conditions \ NOT covered in this Health
Guarantee.
Buyers Responsibilities
When purchasing a puppy from Florida's Fancy Shih Tzu's the buyer
agrees to provide and maintain an adequate lifestyle for said purchased
puppy. These are not suggestions but expectations. Inability to provide
or maintain an adequate lifestyle for said puppy will VOID this 3-year
Health Guarantee as it jeopardizes overall health of said puppy.
* Buyer agrees to maintain sanitary living conditions at all times.
* Buyer will have said puppy fully vaccinated before taking out in
public. This includes a series of puppy vaccinations and rabies
vaccination. All which will be provided by the Buyer.
* Buyer will have puppy spayed/neutered by 7 months old. Puppies
are fertile and can reproduce by the age of six months.
* Buyer understands that said puppy is not to be used for breeding
purposes. If any circumstance occurs where said puppy becomes
bred the contract is VOID and legal ramifications will be sought
this includes a $1000.00 fine to breeder for each puppy produced
and must also surrender said puppy back to breeder.
*Buyer is fully aware this Contract is for a Pet/Companion Puppy.
* Buyer agrees to keep said puppy on High Quality Commercial
Grade Food.
* Buyer understands that Florida's Fancy Shih Tzu's is not
responsible for any neglect that may compromise said puppies
health. This includes but in not limited to starvation, obesity,
malnutrition, or food allergies common to the Shih Tzu breed.
* Buyer agrees to provide any advised Veterinarian recommended
care including but not limited to examinations, vaccines,
preventive care heartworm/parasite etc. Buyer must keep and be
able to provide proof of care.
* Should buyer decline Veterinarian Recommended Care buyer
understands the Health Guarantee may be VOIDED, this is to the
discretion of Florida's Fancy Shih Tzu's.
Replacement Puppy Guarantee Regulations
In order to qualify for the replacement puppy guarantee buyer must be able
to provide proof of Congenital Defect by a licensed Veterinarian. There must
be no signs of neglect or abuse to said puppy. All vet fees acquired are the
buyer’s responsibility. Breeder is not responsible for any vet bills the buyer
accrues. Breeder reserves the right to have a second opinion before honoring
the replacement puppy guarantee.
Replacement Puppy Guarantee only covers a replacement puppy of the
same gender and value. Buyer understands that Florida's Fancy Shih Tzu's
only has a few litters a year. There may be a waiting period before a
replacement puppy is produced. Buyer has the right to wait before taking a
replacement puppy. If buyer chooses a puppy of lesser value, the difference
is forfeit. If buyer chooses a puppy of higher value, they agree to pay any
difference.
Replacement Puppy Guarantee may require the return of said purchased
puppy, at buyers’ expense to be valid. I understand that each circumstance
may be different and may require a different protocol. I reserve the right to
make exceptions to this portion of the agreement. It is to be understood that
this contract voids the Florida Lemon Law. You are signing away your rights
to claim any medical or other expenses. You are also forfeiting the right to
keep said puppy in event a congenital defect is found by a licensed
veterinarian. It is understood that this will be the only contract honored
between both buyer and seller.
Parvo/Distemper
Florida's Fancy Shih Tzu's offers a 72-hour guarantee against
parvo/distemper. This guarantee is VOID should buyer visit any public
places during the 72 hours or if puppy has received a live Dhpp/c vaccine
within 8 days. Should said puppy be diagnosed with parvo/distemper within
the 72 hours buyer must notify breeder IMMEDIATELY before allowing
treatment. Breeder will then decide to continue treatment at buyers’ vet or
have said puppy transferred to own vet to receive treatment. Should buyer
have said puppy treated Without consulting Breeder NO costs will be
reimbursed to the buyer. If said puppy does not survive treatment a
replacement puppy will be offered. Buyer may also return infected puppy
within 7 days to receive replacement puppy. All shipping expenses are
buyers’ responsibility.
Lifetime Home Guarantee
Florida's Fancy Shih Tzu's does not support the surrender of any pets to
pounds, foster homes, or rescue organizations at any time. We understand
that circumstances may arise where the Buyer is unable to provide either the
home or the care to said puppy. If the Buyer must re home said puppy, they
must contact Florida's Fancy Shih Tzu's first. Breeder Guarantees that at any
time for any reason we will take back said purchased puppy. No money will
be refunded in this return. Once the puppy is returned the breeder will then
make arrangements to the breeder’s discretion for said puppy.
Euthanasia
It is to be understood that the breeder, does not euthanize as first option.
Under all circumstances that should arise with any of the pets in my care, we
seek vet advice first and then we follow all recommended protocol. Only
under necessary circumstances where a pet’s quality of life cannot be
maintained with medical intervention would we consider euthanasia. To date
only 2 pets have ever been humanly euthanized.
No other warranties or guarantees are made expressed or implied.
Please note: Due to unforeseen circumstances in both our lives as well as
yours, this contract will be considered VOID if the Breeder is no longer
breeding during the 3-year Health Guarantee.
Any disputes regarding this purchase will be litigated in the Breeders
County and State of residence at the expense of Buyer.
